TERMS OF SERVICE

1. Overview 

These Terms of Service ("Terms") govern your use of HypnoPilot Services ("HypnoPilot", "we", "us"). By accessing or using our website at https://hypnopilot.com/, including all its content, features, communication channels, and services ("Platform"), you agree to be bound by these Terms. If you do not agree, do not use the Platform. You must be at least 18 years old to use HypnoPilot. Our services are exclusively for businesses and professionals. We do not provide services to private individuals. HypnoPilot reserves the right to modify these Terms at any time, with changes becoming effective upon posting. We will notify active users of any material changes via email or platform notifications. Continued use of the Platform indicates acceptance of these changes. We encourage users to review these Terms periodically for updates. All data collected is subject to our Privacy Policy, which is incorporated into these Terms. As a Germany-based company, we comply with the General Data Protection Regulation (GDPR) and other applicable data protection laws to ensure transparency and user data protection. 

2. Payment Processing & Refund Policy

a. Payment Processing 

All online payments are securely processed through Stripe. If Stripe is unavailable, we support additional payment processors, including Authorize.net, NMI, Square, and PayPal. HypnoPilot does not store or handle credit card details directly. By making a payment, you agree to the terms of the respective payment provider:

b. Pricing & Subscription Fees 

Our subscription plans are flat-rate with no per-client or per-team-member charges. Fees are billed monthly or annually, depending on the selected plan. We reserve the right to adjust pricing, with advance notice to active subscribers. Payments are non-refundable, except where explicitly stated. If you experience technical issues preventing access to our platform, please contact [email protected], and we will work to resolve the issue as quickly as possible. Refunds will only be considered in exceptional cases where services were not delivered as promised and at HypnoPilot’s sole discretion.

c. Trial & Subscription Policy 

We offer a 14-day free trial that provides full access to all platform features. After the trial period, a monthly or annual subscription applies based on the selected plan. Once the trial ends, the selected subscription fee will be charged automatically unless canceled before the trial expires. All subscription payments are non-refundable, and cancellations take effect at the end of the current billing cycle. Custom services, such as branding, website development, advertising, or Google Business Profile optimization are non-refundable, as they require upfront work and customization tailored to each client.

3. Data Protection & GDPR Compliance 

As a Germany-based company, HypnoPilot strictly follows GDPR (EU Regulation 2016/679) to ensure user data is processed lawfully, fairly, and transparently. 

Our platform's core software is provided by third-party services, which act as our GDPR-compliant data processors. Data may be stored on secure servers within or outside the EU, depending on service features. We implement Standard Contractual Clauses (SCCs) to ensure compliance with cross-border data transfer regulations. Clients can request a copy of their data, updates, or permanent deletion in accordance with GDPR requirements. For more details, refer to our Privacy Policy. 

4. Account Cancellation & Data Handling

Users can securely export their client information before canceling their account.

Upon cancellation: The account enters an inactive state for 60 days. During this period, users can reactivate their account without data loss. After 60 days, all data, including client records, is permanently deleted. Users may also request immediate deletion of their account at any time. 

5. Hypnotherapist Responsibility & Client Data Handling 

As a HypnoPilot user, you are responsible for ensuring that your clients agree to your own Terms of Service and Privacy Policy. You must obtain proper consent before storing or processing any client data within HypnoPilot. If you handle sensitive data, such as client health information, you must ensure compliance with GDPR and any applicable local regulations regarding data protection and confidentiality. HypnoPilot does not access or process hypnotherapy session notes, medical records, or any highly sensitive client data. Users are fully responsible for securing such data and ensuring compliance with relevant privacy laws. 

6. Third-Party Services & Data Processing 

HypnoPilot provides marketing automation, CRM, and business management tools specifically designed for hypnotherapists. Our platform integrates with trusted third-party technology infrastructures, which we have extensively customized with exclusive features, seamless integrations, and dedicated customer support. While HypnoPilot provides special features, onboarding, training, and ongoing support, the core software infrastructure is powered by GoHighLevel, Inc., which serves as our data processor under GDPR, handling core CRM, automation, and communication services. Additionally, Cloudflare, Inc. acts as the hosting provider and data processor for websites created and managed through HypnoPilot, ensuring security, performance optimization, and data protection. By using HypnoPilot, users acknowledge that while we customize and enhance the platform for hypnotherapists, these third-party providers are responsible for maintaining the underlying infrastructure, security, and data processing in compliance with applicable laws. 7. HypnoPilot Mobile Terms of Service

a. Users may receive messages regarding their account status, billing, service changes, and other essential updates necessary for maintaining their subscription and access to HypnoPilot. Additionally, if consent is given, users may receive occasional marketing messages, including offers, tips, and updates about new features.

b. Users can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," HypnoPilot will confirm the unsubscribe status via SMS. Following this confirmation, users will no longer receive SMS messages from us. To rejoin, users must sign up as initially done, and we will resume sending SMS messages to them.

c. If users experience issues with the messaging program, they can reply with the keyword HELP for more assistance, or reach out directly to [email protected].

d. Carriers are not liable for delayed or undelivered messages.

e. As always, message and data rates may apply for messages sent to users from HypnoPilot and to HypnoPilot from users. Message frequency varies. For questions about text or data plans, users should contact their wireless provider.

8. Limitation of Liability & Indemnification 

HypnoPilot is not responsible for service disruptions caused by GoHighLevel, Stripe, PayPal, Authorize.net, NMI, Square, or other third-party providers. HypnoPilot is not liable for indirect, incidental, or consequential damages, except as required under EU consumer protection laws. Users agree to indemnify HypnoPilot against claims arising from their use of the Platform, including but not limited to: Misuse of communication tools. Non-compliance with GDPR, TCPA, or CAN-SPAM regulations. Unauthorized business practices conducted through the Platform. 

9. Communications & Marketing Compliance 

HypnoPilot allows users to send automated client communication (e.g., booking confirmations, reminders, follow-ups) from their own accounts, using the phone numbers and email addresses they have purchased and set up.

Users are responsible for ensuring that all communications comply with applicable laws, including: 

GDPR (data protection & consent requirements). TCPA (SMS & call compliance in the U.S.). CAN-SPAM Act (email marketing compliance in the U.S.). 

HypnoPilot does not initiate, control, or send messages on behalf of users. Users are solely responsible for ensuring that their communications comply with applicable laws and regulations. 

10. Applicable Law & Dispute Resolution 

These Terms are governed by German law. Any disputes shall be settled under the jurisdiction of German courts. If you are an EU consumer, you have the right to resolve disputes via the EU Online Dispute Resolution (ODR) platform. 

11. Company Information 

HypnoPilot is operated by Paul Kunad as a sole proprietorship. This is not a registered corporation (GmbH or LLC).
